Zusammenfassung

This book provides an intellectual history of how English criminal law has governed sex between men from the Middle Ages to the present.

Tracing a complex pattern of shifting legal techniques, from the medieval deployment of sin to contemporary risk management, the book provides a sustained juridical genealogy of the regulation of sex between men. At the centre of the book is the figure of what is referred to as the 'out-law': positioned at the boundary of legality, and whose exclusion defines the limits of belonging. And, challenging any simple narrative of progress in law's relationship to male same-sex desire the book demonstrates how, even after decriminalisation its governance persists through doctrines of visibility, shame, and technocratic control. English law, the book concludes, has never simply repressed or liberated same-sex desire; rather it has continually reinvented techniques for governing it.

This book will appeal to scholars and students with relevant interests in the areas of legal history, gender studies and criminal law.

Max Barrett, is a Judge of the High Court of Ireland, where he currently sits on the Chancery list and heads the Competition Law list. He has also sat as an occasional judge of the Court of Appeal, and previously presided over family, child, and immigration law matters. Before his appointment to the bench, Mr Justice Barrett accumulated extensive senior in-house, regulatory, and commercial legal experience in a variety of financial services groups. An accomplished legal scholar, his academic credentials include an LL.B. from Trinity College Dublin, a first-class M.A. in competition law from King's College London, a first-class M.A. in Literature from Dublin City University, and a Ph.D. in Law from the University of Salford, where he attended on a full scholarship. e is an Editorial Board member of the Irish Judicial Studies Journal, has lectured to the Ukrainian judiciary under Council of Europe programmes, and serves as an external examiner for the Law Society of Ireland and King's Inns.
